I've just noticed tonight that if someone who hasn't clicked YES to the Player Agreeement joins the server after someone is OUT, the person who just joined comes in alive after clicking yes on the agreement.
Im hoping this is a one time thing when they need to agree because it would be a huge hole. I havent noticed it happening much so I think it's just the first timers who get in alive.

That's correct. It's a one time thing, the first time they click yes...

I just found this thread and installed 1.08 yesterday... I changed quite a lot on my server (adding and configuring SMP). Though for the last 2 days, no one has joined my server successfully. I finally figured something out though. Everyone's been having problems downloading this package, but the odd thing is that it's on the redirect server (gameservers.net).
What even more strange is I downloaded it and decompressed it and for some reason, it's larger than the one that I downloaded here. By 84 bytes, meaning it's 30417 bytes and the one I downloaded here is 30333 bytes. I exported the source for both and all the classes are the same size.
I need to know, which one should I use? The 30417 byte one or the 30333 byte one?

I didn't upload it to gameservers so I dont know what the story there is. Maybe before I post this anywhere more public, I'll recompile it with a new version number.
